1. Acceptance

These Terms of Use ("Terms") govern your use of the Tonely mobile app and the tonely.studio website (together, the "Service"). By using the Service you accept these Terms. If you do not agree, please do not use the Service.

2. The Service

Tonely performs AI-based personal color season analysis from a selfie you upload; it places you into one of the 12 color seasons and provides a personal color palette and style advice. Part of the Service is free; the full palette and additional features are unlocked with a one-time purchase.

3. Entertainment and Style Advice — Disclaimer

Tonely's results are provided for entertainment and style-advice purposes. The results:

• are not a medical, dermatological or other professional assessment and must not be used as one,
• carry no claim of absolute accuracy; lighting conditions, photo quality and similar factors can influence the outcome,
• do not replace your personal taste and preferences.

4. Accounts and Eligibility

You must be at least 13 years old to use the Service. You are responsible for the security of your account. You may only upload photos of yourself or photos you are authorized to use; uploading a photo of another person without their permission is prohibited.

5. One-Time Purchase (Premium)

• Premium is a one-time, permanent unlock (non-consumable). It is not a subscription; there are no recurring charges.
• The purchase is processed and billed by Apple through the App Store. The price is the price shown in the App Store at the time of purchase.
• When you change devices, you can restore your purchase using the "Restore Purchases" button in the app.
• Refund requests are subject to Apple's refund policy and are handled by Apple (support.apple.com/billing).

6. Apple Standard EULA

Your use of the app obtained through the App Store is additionally governed by Apple's standard Licensed Application End User License Agreement ("Standard EULA"): apple.com/legal/internet-services/itunes/dev/stdeula. In case of conflict between these Terms and the Standard EULA, the Standard EULA prevails with respect to your relationship with Apple.

7. Acceptable Use

You may not use the Service unlawfully, reverse engineer it, flood it with automated requests, or upload content that violates the rights of others. We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content — including the Tonely name, logo, design, palette data and software — is owned by or licensed to Tonely. You retain ownership of the photos you upload; you grant us only the limited processing permission needed to perform the analysis. You are free to share your own result card for personal purposes.

9. Privacy

For information about how we process your personal data, see our Privacy Policy. Photos are deleted within at most 7 days after the analysis.

10. Warranty Disclaimer and Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by applicable law, Tonely makes no warranty as to the accuracy of results or uninterrupted, error-free operation, and shall not be liable for indirect damages. Mandatory consumer protection rights remain unaffected.

11. Changes

We may update these Terms from time to time. Material changes will be published on this page; continuing to use the Service after a change means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. Mandatory rights of consumers under the laws of their country of residence remain unaffected.
